Occupational health and safety law is constantly changing. There are two types of law viz. criminal law and civil law. The sources of law are found in statute law, common law and european law and directives. Statute law emanates from Parliament as Acts and Regulations. Common law relies on judge made law, often unwritten and adopting the principle of precedence. European directives begin in the European Commission and after agreement between the Council of Ministers and the European Parliament form the basis for change in the member states. Case law can be used to interpret the meaning of both statute law and common law. New cases and judgements can change the thinking on health and safety issues.
